1. Acceptance of These Terms

By accessing or using the Zac Motors website, mobile application, or any of our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you should not use our platform. These Terms constitute a legally binding agreement between you and Zac Motors Limited ("we," "our," or "us").

2. Eligibility

Our services are available to individuals who are at least 18 years old and capable of forming a legally binding contract. By using our platform, you confirm that you meet these requirements and that all information you provide to us is accurate, current, and complete.

3. Description of Services

Zac Motors operates a marketplace for verified, premium vehicles. Our services include vehicle browsing, professional inspections, booking and reservations, purchase transactions, delivery and logistics coordination, and post-purchase support. We may modify, suspend, or discontinue any part of these services at any time, with or without notice.

4. Vehicle Listings and Information

We make every effort to ensure that vehicle listings are accurate, including year, make, model, mileage, and condition. However:

• All vehicle information is provided "as seen" and subject to prior sale.
• Images may differ slightly from the actual vehicle due to lighting or minor condition changes.
• Prices are subject to change without notice and may exclude registration or transfer fees.
• A vehicle is only reserved once a booking or purchase agreement has been confirmed by us.

5. Vehicle Inspections

All vehicles on our platform undergo a professional inspection by our certified team before being listed as ZAC-verified. Inspection reports are provided for transparency and guidance only and do not constitute a warranty of any kind. You are encouraged to:

• Review the full inspection report before purchase.
• Request an independent inspection at your own cost if you wish.
• Physically verify the vehicle before completing your purchase.

6. Bookings and Reservations

You may book a vehicle for inspection or reserve it for purchase. By placing a booking you agree that:

• Bookings are subject to vehicle availability and may be cancelled by either party.
• Any reservation deposit paid will be applied toward the purchase price.
• Reservation deposits may be forfeited if the vehicle is not purchased within the agreed timeframe.

7. Purchases, Payments and Financing

When you purchase a vehicle through our platform:

• Payment is due as agreed in your purchase contract or order confirmation.
• We accept secure payments through approved channels and may offer flexible payment terms of up to 72 months, subject to eligibility and approval.
• Title to the vehicle transfers to you only after full payment has been received and cleared.
• We do not store your full card details; payments are processed by accredited payment providers.

8. Delivery and Logistics

We offer delivery of purchased vehicles within Nigeria. Delivery timelines are estimates and may be affected by factors outside our control, including traffic, weather, and customs processes.

• Delivery charges, if any, will be communicated before you complete your purchase.
• Risk in the vehicle passes to you upon delivery or handover, whichever occurs first.
• You are responsible for registering and insuring the vehicle after purchase.

9. Refunds, Returns and Warranties

Our refund, return, and warranty policies are outlined at the point of purchase and in our refund policy. In general:

• Refunds for deposits or payments are handled in line with the applicable policy at the time of purchase.
• Vehicles sold are subject to the terms of any written warranty provided, if applicable.
• Warranty claims must be reported within the stated warranty period with supporting documentation.

10. User Conduct and Responsibilities

You agree not to use our platform to:

• Provide false, misleading, or fraudulent information.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Interfere with the operation of the platform, including through malware or automated abuse.
• Resell, misuse, or misrepresent any vehicle, service, or content obtained through us.
• Violate any applicable law or regulation.

11. Intellectual Property

All content on our platform, including logos, text, graphics, images, software, and the overall design, is the property of Zac Motors Limited or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written consent.

12. Disclaimers of Warranties

To the maximum extent permitted by law, our platform and services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, secure, or error-free.

13. Limitation of Liability

To the maximum extent permitted by law, Zac Motors Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or in connection with your use of our platform or services. Our total liability for any claim shall not exceed the amount you paid to us in connection with the transaction giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless Zac Motors Limited, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of your use of the platform, your violation of these Terms, or your violation of any rights of a third party.

15. Privacy and Data Protection

Your use of our platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our platform, you consent to the practices described in the Privacy Policy.

16. Third-Party Services and Links

Our platform may contain links to, or integrate with, third-party services such as payment processors and logistics providers. We are not responsible for the content, practices, or availability of these third parties, and your use of them is subject to their own terms and policies.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising out of or in connection with these Terms shall first be referred to negotiation between the parties in good faith. If the dispute is not resolved, it shall be submitted to the exclusive jurisdiction of the courts of the Federal Capital Territory, Abuja.

18. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. The latest version will always be posted on this page with a revised effective date. Your continued use of the platform after any changes constitutes acceptance of the updated Terms.

19. Severability
